Session Court reserves order

IMPHAL, Jun 4: The Session Court, Imphal West has reserved its order till June 10 regarding the criminal review petition filed by the 13 Dogra, presently stationed at headquarters 57 Mountain Division, Leimakhong against the order passed by the CJM Imphal West which raised 10 points of reference to the High Court Manipur to enable the Court take an appropriate decision in the alleged fake encounter cases where prosecution sanction is denied against defence/paramilitary personnel by Union of India.
The order was reserved after hearing all parties in length today.
During the hearing, Additional Solicitor General Kh Samarjit, assisted by Advocate Jasobanta and Captain B Jayant represented Union of India, Sandeep Kumar Singh represented CBI while O Kiranjit assisted by Nautunkumar represented EEVFAM.
The Special PP, CBI submitted that EEVFAM does not fall within the meaning of victim under Section 2 of WA of CrPC and hence not a necessary party.
The Court, after hearing all the parties, reserved its judgment order regarding the criminal review petition which challenged the order passed by the CJM Imphal West that raised 10 points of reference to the High Court of Manipur to enable the Court take an appropriate decision in the alleged fake encounter cases where prosecution sanction is denied against defence/paramilitary personnel by the Union of India.
 Mention may be made that the High Court of Manipur had directed the Session Judge, Imphal West to dispose the criminal review petition of the Union of India on or before June 13.
During the hearing of the case, the Court impleaded EEVFAM as a respondent and issued notice to EEVFAM on May 17.
