IMPHAL, May 11 : The Chief Judicial Magistrate, Imphal West on Wednesday directed the SP of CBI Special Crime Branch Kolkata to submit the status report of the reinvestigation of N Babysana's mysterious death case on or before May 30.
The case CBI versus Nongmaithem Jinnty of Yaiskul Moirangkhom Sougaijam Leirak, Kamei Ileen, Langthabal Chingthak near Manipur University, Pheiroijam Robinson Singh @ Boicha, of Canchipur, near Manipur University Gate, Pheiroijam ongbi Longjam Ningol Landhoni Devi, of Canchipur, near Manipur University Gate, Imphal West, Manipur; and Pheiroijam ningol Karam ongbi Romita Devi of Kwakeithel Thiyam Leikai was placed before the Court today.
On March 31, 2021, the Additional SP of CBI SCB Kolkata had filed the final form under Section 173 CrPC in connection with N Babysana's mysterious death case stating that  a chargesheet could not be submitted against the  accused as no evidence emerged during investigation.
Not satisfied with the final report, father of N Babysana filed an application on April 28, 2021 under Section 173(8) CrPC along with a prayer to reinvestigate the case after a DNA profiling of the AB blood group found in the left middle finger of the deceased and to ascertain whether the boarding owned by accused Ph Landhoni could be legally registered under Manipur Shop & Commercial Establishment Act, 1972.
The Court after hearing the final form and applications filed by the father of the deceased observed that “the investigation of the case conducted by the IO is not satisfactory” and thus rejected the final form and sent it back for further investigation under Section 173(8) CrPC on November 16 last.
The Court assumed that some substantive progress would have been made by now in the reinvestigation as more than  five months have lapsed since the direction for reinvestigation was issued.
In pursuance of the Court’s order, the CBI, Kolkata sought permission to unseal the box received from the Director of FSL Pangei and the said prayer was allowed by Court on March 28.
