HC quashes detention order

IMPHAL, Oct 21: A division bench of High Court of Manipur yesterday quashed and set aside a detention order issued by the Special Secretary Home, Government of Manipur on February 2, 2020 against Abbas Ahamad for his alleged involvement in drug trafficking. The Court order authorities concerned to release him if he is not required in any other case.
The division bench comprising Justice Kh Nobin and Justice Ahanthem Bimol was hearing a writ petition filed by Md Rashid Ali challenging the validity and correctness of the detention of his elder by an order of Special Secretary (Home) Government of Manipur on February 2, 2020.
During the hearing held via video conference, the Court observed that provision of Section 3(2) of the Prevention of Illicit Traffic in Narcotic drugs and Psychotropic Substance Act 1988 has been violated and that the order of detention is bad in law and liable to be quashed and set aside.
Hence, the Court quashed and set aside the detention order and direction that Md Abbas Ahamad (36) @ Moichingmayum Abas Mastana of Moijing Awang Leikai be released, if he is not required in any other case.
It may be noted that on January 18, 2020 a combined team of Thoubal and Bishnupur district commando had nabbed Md Abbas Ahamad on the alleged charges of being a kingpin of vehicle lifters and drug manufacturing gang. Based on his disclosure, the combined team claimed to have recovered one stolen four wheeler Creta and a Bullet motorcycle.
Md Abbas Ahamad was arrested after two of his alleged associates, who were arrested on January 15 along with equipment and chemical used in manufacturing brown sugar, revealed his name.
