IMPHAL, Nov 27: Chief Judicial Magistrate, Imphal West, today, ordered Pheiroijam Robinson, Junior Administrator of Standard Robarth Higher Secondary School, to be given bail on executing a PR bond of Rs 2 lakh and two sureties of the same amount.
The order was passed following the hearing of the bail application filed by Robinson through his counsel in connection with the death of Ningthoujam Babysana inside the hostel of the school in the morning of July 18.
Robinson's medical report was also submitted by the SP of Manipur Central Jail, Sajiwa, for the hearing today.
His counsel submitted that Ph Robinson is the Junior Administrator of Standard Robarth Higher Secondary School and has no connection with death of the victim and mentioned that the post mortem report pointed out the cause of death as asphyxia due to hanging.
Robinson is innocent of the charges levelled against him and he has been wrongly incarcerated in jail for 4 months now causing great health hazard and he is having psychological problems which require proper medical care and attention, the counsel claimed, submitting his medical report.
On the other hand, the APP of the State contended that medical reports are just documents developed for every person detained in custody, and a medical record is not sufficient for securing the release of Robinson on bail.
After going through the case records, the medical report and the submission of both sides, the Court order Robinson to be to released on bail by executing a PR bond of Rs 2 lakh with two sureties.
It may be mentioned that Single Bench, High Court of Manipur, allowed the bail of Pheiroijam Landhoni (Principal of the school) and her daughter Pheiroijam Romita (coordinator) on November 6, upon execution of necessary PR bonds of Rs 1 lakh each before the Court of Judicial Magistrate First Class, Imphal West II.
The High Court has also directed the CBI to take up the investigation of Babysana within 2 months.
On the other hand, the JAC which was formed in connection with the death of Babysana has alleged that despite the order of the High Court to let Babysana's case be investigated by the CBI, the SIT which was earlier formed to investigate the incident, has failed to submit all the necessary reports and documents to the CBI till date.
A statement issued by the convenor of the JAC warned that if the deadline specified by the High Court expires without any positive response from the authorities concerned, then the JAC will be compelled to take up stringent actions.
The family members of late Babysana are yet to perform the last rites of the deceased and it will be done only after the CBI takes over the case, it added.
